How Long Do You Have to Settle a Georgia Car Accident Claim or File a Lawsuit?

The statute of limitations (the time you have to file a lawsuit) for personal injury claims in Georgia, O.C.G.A. 9-3-33 is two years from the date of the accident. If you don’t file a lawsuit before then, you lose the right to recover compensation. There are some limited exceptions to this deadline, such as the limit may be sometimes extended when the at-fault driver was ticketed or charged with a related crime, or due to the victim being a minor or incapacitated, but these extensions are exceptions that must be carefully researched – and should be handled by an attorney.
