Does insurance have to pay for a rental car if I was not at fault?
The at-fault driver’s liability insurance is legally responsible for your loss-of-use damages, including rental costs, as part of property damage recovery. They are not required to pay, however, until they accept liability, which is why using your own coverage first is often faster.
Can I recover Uber expenses instead of renting a vehicle?
Yes. Many insurers will reimburse rideshare costs up to your daily rental limit if you’d rather not rent a car. Keep every Uber and Lyft receipt. Without documentation, the insurance company will deny reimbursement.
What happens if repairs take longer than insurance approved?
Get a written statement from the body shop explaining the delay and submit it to the insurance company. Reasonable extensions are almost always granted when delays are due to parts backorders or newly discovered damage rather than the customer.
Can I choose a larger rental vehicle?
Insurance typically only pays for a vehicle comparable to yours. If you choose a larger or more expensive vehicle, you’ll pay the difference unless you can show a legitimate need (for example, a pickup you use for work).
What if I cannot afford the rental car deposit?
Some rental agencies accept debit cards or cash deposits, but terms are stricter. Your insurer may also be able to arrange a “direct bill” rental at a partner agency that waives the deposit.
What happens if my car is totaled?
Rental coverage typically ends 3–7 days after the insurer makes its total-loss settlement offer. If you’re disputing the valuation under Georgia law, including diminished value, you may be able to argue for an extension.

Your UM/UIM coverage under O.C.G.A. § 33-7-11 may pay for property damage and, depending on your policy, rental expenses. Georgia is an add-on UM state, so multiple UM policies can stack.
