Keep in mind that a driver who was drinking or using drugs (including controlled substances or prescription drugs) does not have to be convicted of DUI (driving under the influence) for the driver, dram shop or social host to be held liable in an accident lawsuit. However, proof that the driver was legally impaired certainly helps in making a claim.
