The management company failed to file an Answer to the Complaint, but later hired an attorney to set aside the default, blaming the insurance company for not filing an Answer. Although Courts usually open default, our lawyers Justin Oliverio and Bruce Millar were able to successfully argue in both the Trial Court and the Georgia Court of Appeals that the management company had failed to check to be certain its insurance company had filed an Answer. Once our firm won the Appeal, the insurance company wrote a large check.
$450,000 Mediated Settlement for Child Injured Falling Hotel TV
Our firm negotiated a settlement of over $450,000 for a child who was injured when a hotel room television fell on him. In this case, the hotel had placed an old 32-inch picture-tube TV on a small chest of drawers. When the child opened the top drawer, the entire cabinet and television tipped over onto him. Our firm filed suit and retained a furniture safety expert, whose investigation showed that the hotel violated industry and safety standards, helping secure a substantial settlement.
$425,000 Hotel Television Tip-Over
In the fall of 2022 our firm successfully recovered over $425,000 for a child injured when a large television overturned on him in a hotel room. The hotel tried to blame the child and his parents for pulling the television over. Our firm hired a commercial furniture expert to analyze the incident. The expert determined that the television was not properly secured and was too large, so that when the child opened a drawer, the TV and dresser became unsteady and toppled over.
$250,000 Broken Chair at an Atlanta Hotel
In the spring of 2020 our office recovered $250,000 for an out-of-town visitor who was injured at a major Atlanta hotel chain when the chair she sat in collapsed. The incident happened when she sat in a chair in the business center.
